2. Scope of application

These terms of use apply to the use of the mobile application "Karl: Kcal Tracker and Habits" (hereinafter "App").

By registering and using the app, the user agrees to these terms of use.

3. Subject matter of the contract

The app offers digital functions for:

  • Recording and analysis of nutritional data
  • Calculation of calorie requirements (BMR, TDEE)
  • Calculation of Body Mass Index (BMI)
  • Tracking of fitness activities and habits

Use is exclusively within the framework of the provided functions.

4. Registration and user account

  1. A user account must be created to use the app.
  2. The user is obliged to:
    • provide truthful information during registration
    • treat their access data confidentially
    • not allow unauthorized access by third parties
  3. The user is responsible for all activities via their account.

5. Health-related notices and Use of AI (Artificial Intelligence)

  1. The app serves exclusively for information, motivation, and support purposes.
  2. The app:
    • is not a substitute for medical, therapeutic, or professional nutritional advice
    • does not constitute a medical diagnosis and does not treat any illnesses
    • is not a medical device within the meaning of Regulation (EU) 2017/745 (MDR)
  3. The app provides AI-powered features (e.g., the "Karl AI Coach" / AI Chat and the AI image analysis of meals). When using these features, the following applies:
    • The user interacts with an artificial intelligence system (AI transparency notice in accordance with the EU AI Act).
    • The answers and analyses are generated automatically. AI systems can make mistakes or generate inaccurate or incorrect statements (so-called hallucinations).
    • The user must not rely on the AI-generated statements without verification. In particular, for health-related decisions, allergies, or intolerances, independent verification or professional advice must be obtained beforehand.
    • The provider assumes no liability for the accuracy, completeness, or reliability of the AI-generated information.
  4. All calculations (e.g., calorie requirements, BMI) are based on generally accepted formulas and represent only approximate values.

6. Duties of the user

The user undertakes not to misuse the app, in particular:

  • not to enter false or misleading data
  • not to distribute illegal content
  • not to bypass technical measures

7. Availability of the app

  1. The provider endeavors to ensure that the app is available as without interruption as possible.
  2. However, availability at all times is not guaranteed.
  3. Maintenance work, further developments, or technical malfunctions can lead to restrictions.

8. Changes to the app and the terms of use

  1. The provider reserves the right to change, expand, or discontinue the app or individual functions at any time.
  2. Changes to these terms of use will be communicated to the user in a timely manner.
  3. If the user continues use after the changes take effect, this counts as consent.

9. Liability

  1. The provider is liable without limitation in the event of intent and gross negligence as well as damage to life, body, or health.
  2. Otherwise, liability is excluded, in particular for inaccurate calculations or prognoses, health consequences of use, and incorrect entries by the user.
  3. Use of the app is at your own risk.

10. Termination and blocking

  1. The user can delete their account at any time.
  2. The provider reserves the right to block or delete user accounts if these terms of use are violated.

11. Data protection

The processing of personal data is carried out in accordance with the privacy policy.

12. Applicable law

The law of the Federal Republic of Germany applies.

13. Dispute resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
